We respect the intellectual property rights of others and respond to notices under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512. We may host content from partners or user-generated content (e.g., product reviews, images). Where we receive a valid DMCA notice, we may disable or remove the reported material and, when appropriate, suspend or terminate repeat offenders.

1) Scope & Repeat Infringers

Upon receipt of a valid notice, we may block or remove content and may terminate accounts for repeated violations. (Modeled on common marketplace procedures.)

2) How to Send a DMCA Takedown Notice

To help us process your claim quickly, your notice should include all of the following (required by 17 U.S.C. §512(c)(3)):

  1. Identify the copyrighted work (or a list of works) you claim has been infringed. Include registration numbers if available.
  2. Identify the material that is infringing and provide its location on our site with enough detail for us to find it (direct URLs to product or image pages are best).
  3. Your contact information: full name, mailing address, phone number, and email.
  4. Good-faith statement that the disputed use is not authorized by the rights owner, its agent, or the law.
  5. Accuracy & authority statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Signature (physical or electronic). Typing your full legal name is sufficient for an electronic signature.

3) What Happens After We Receive a Notice

  1. We will remove or restrict access to the reported material and notify the user who posted it.
  2. We may request additional information if your notice is incomplete.
  3. We maintain a policy to remove content and, where appropriate, terminate accounts of repeat infringers.

4) How to File a Counter-Notice (If Your Content Was Removed)

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice that includes:

  1. Identification of the material that was removed and the location where it appeared before removal (URLs).
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification.
  3. Your name, mailing address, phone number, and email.
  4. Your consent to the jurisdiction of the U.S. Federal District Court for your address, or if outside the U.S., any judicial district where we may be found, and your agreement to accept service of process from the original complainant.
  5. Your physical or electronic signature (full legal name).

Send your counter-notice to support@gettrendmerch.com. If we receive a valid counter-notice, we may forward it to the original complainant. Unless the complainant notifies us that they have filed an action seeking a court order, the removed material may be restored after 10–14 business days.

5) Misrepresentations

Under 17 U.S.C. §512(f), any person who knowingly misrepresents that material or activity is infringing—or that it was removed by mistake—may be liable for damages (including costs and attorneys’ fees). Please consider seeking legal advice before filing a notice or counter-notice.

  • Attach or link representative samples of your work (e.g., registration, official page) when possible.
  • Provide clear, direct URLs to each allegedly infringing page.
